Masks and Rights

This post was inspired by the aggressive ignorance of this woman (video) who insisted that she had the RIGHT to transact business in her bank without complying with its demand that she wear a mask.

In a previous post, an important takeaway is the # of Americans who could pass a basic Citizenship test, only 38% of us!  A corollary of that fact is that a clear majority of us do not understand what our so-called RIGHTS really are.

By definition, our legal (and Constitutional) rights are established in our Declaration of Independence, our Constitution, our Bill of Rights, and the rest of the amendments to the Constitution.

This ignorant woman asserted her RIGHT not to wear a COVID-19 mask in a private establishment, a bank fgodsake!  Which begs the question: whose rights trump whose rights?   In other words, do HER rights prevail over the rights of the owner/manager of the bank?

So, what is the formula for whose rights prevail when there is a conflict of rights?  Simple.  Sovereignty rules.  “What?”   If you are a passenger on my boat, my rules prevail.  If I am a passenger on your boat, your rules prevail.   If I am a guest in your home, your rules prevail.  If you are a guest in my home, my rules prevail.  If I am a customer in your store, your rules prevail.  If you are a customer in anyone else's store, the owner/manager’s rules prevail.  Simple.   If you are shopping or conducting business anywhere that does not belong to you, their rules prevail.   It has NOTHING to do with individual rights, as individual rights protect you from the government's power, not from Walmart’s or Bank of America’s rules.

Over the years, we have seen our RIGHT to smoke cigarettes anywhere we pleased rolled back.  Our RIGHTS to bear arms anywhere we pleased have also been threatened.  Now our RIGHT to walk mask-less anywhere we please is also under attack.  Tough.  Get used to it!  A lot of us need to spend some time really learning about the Constitution and our legal system.  It’s not that complicated.  But it is not as simple as that angry woman thinks it is either.

  1. It frustrates me that people don't consult history. Back in 1918, it was considered patriotic duty to wear a cloth mask, in public, because there was a war, and we couldn't afford for many people to be out sick, or out dead.

    I wish I could say it disappoints me that it's so easy to find ignorant people, and it's so easy for them to get media coverage.

  2. PSD, yeah! It is easy for people to be stuck inside their own body and brain. And difficult to challenge an old thought. We were "designed" to survive, not to be smart or rational. Maslow's Hierarchy of Needs.
